THE CONSTRUCTION PRACTICE

Our Construction Practice represents clients in all phases of a construction project, from the initial drafting and negotiating of contracts to litigation and dispute resolution. Lawyers in our Construction Practice are knowledgeable in insurance law and have substantial experience in addressing insurance coverage matters, including triggering insurance.

CONTRACTS

We have negotiated and drafted hundreds of construction and related professional services contracts. These include domestic and international contracts for industrial facilities and infrastructure projects valued up to $1.2 billion. We have advised clients on construction projects, including airports, bridges, petrochemical plants, hotels, cogeneration facilities, shopping centers, mining facilities, and others.

DAY-TO-DAY MANAGEMENT ISSUES

We understand that construction projects present a wide range of legal issues, ranging from mechanics’ liens to developing and responding to change orders and delay claims, to evaluating whether to terminate a general contractor or others for default, and to addressing risk management issues. Clients depend on our ability to efficiently and comprehensively assist and advise them during the course of a project and, when disputes arise, to investigate, litigate, mediate, and arbitrate construction and engineering disputes. We also understand the potential high-costs that invariably arise from disputes and, in order to avoid these, we help clients to anticipate and resolve potential disputes and claims early and where there is a potential to prevent or mitigate the impact of such disputes and claims.

CONSTRUCTION CLAIMS

L&K lawyers also assist clients in the preparation of, and in responding to, contract claims—such as delay claims, acceleration claims, changed condition claims, and extra work claims—relating to both private and public works projects.

CONSTRUCTION LITIGATION

We have represented owners, contractors, and public entities in complex litigation, such as a $340 million lawsuit involving an area airport and a $200 million lawsuit involving an area hospital. We have also represented clients in mechanics’ liens actions and defended clients in other construction related disputes, including personal injury lawsuits, both within and outside of the statutory directives of California’s worker’s compensation statutes.
